(1).  Registration

Early Learners Nursery Limited offer a definite / provisional place to the child referred to on the registration form who is to join the nursery on the following terms. These terms and conditions relate to the contract between the nursery and the parents / guardian. The headings in this agreement are inserted only for convenience and shall not affect its constructions.

(2).  Deposit

A deposit as referred to on the registration form shall be paid by the parent/ guardian to the nursery on submission of completed registration form and that fee shall not be returnable. The registration fee will be returned if the nursery cannot offer the place on the schedule and date required.  Registration fee includes induction and taster sessions. The deposit is not deductible from the first month’s fee’s.  Parents only claiming F.E.E (Free Early Entitlement) are not required to make a deposit.

(3).  Payment of Fees

You agree that the payment of fee’s for the child’s attendance at Early Learners  shall be made by the parent / guardian monthly, in advance, between 15th and 28th of each month (the due date) by standing order (BACS / Internet banking).

us to receive your payment:

 

  1. If said payment for childcare costs does not reach ourselves by the 1st of each month a late charge will be applied.  Early Learners do not accept monies in arrears, all monies must be made in advance.  Childcare vouchers must be also setup and received prior to the 1st.
  2. It is the responsibility of the parent/ guardian to reference any payment with the child’s name and ensure this payment is set up with a bank.
  3. If the payment of the fee’s referred to above shall be outstanding for more than 5 working days then the nursery may cease the childcare place with immediate effect and terminate this contract. Upon termination of this contract the child shall cease forthwith to be admitted to the nursery.  Early Learners will issue with a formal demand for all outstanding monies and if applicable seek legal action to recover monies owed.
  4. Fees may be charged per session for part-month attendance for new registrations only.  Changes of sessions need to be submitted in writing and changes will only commence on the 1st monthly.
  5. The nursery reserves the right to increase the said fees at any time upon giving one calendar month’s written notice of the proposed increase to the parent / guardian.

(4).  Calculation of Fees

  1. The nursery year runs from September 1st to August 31st.  The nursery closes for one week at Christmas and all other Bank Holidays.
  2. The fees payable by the parent/ guardian are calculated by taking the child’s weekly attendance fee, multiplying the same by 51, being the number of weeks the nursery is open, and dividing by 12 to give a monthly payment which is required in accordance with clause 3(i).  The nursery does not permit the payment of fees on a daily or weekly basis. Any payments by a parent/ guardian upon this basis may be regarded by the nursery as a breach of the parent/ guardian payment obligations and the nursery reserves the right to terminate this agreement upon serving 5 days notice of the parent/ guardian payment default. Upon the expiration of said  5 days notice and parent/ guardian having failed to remedy their payment default then the nursery shall be entitled to treat this agreement as terminated and the provision of clause 3(iii) shall apply.
  3. The nursery does not permit the pro-rata reduction of payment fees if the child is absent from the nursery due to illness or holidays whilst the nursery is open. The parent/ guardian is therefore obliged to make full payment. In the event of payment not being made then the nursery reserves its right to terminate this agreement in accordance with clause 3(iii).

(5).  Cancellation/ Termination

  • After an offer has been made by the nursery but before acceptance by the parent/ guardian either party may cancel the offer by serving 7 days written notice.
  • After acceptance of the offer by the parent/ guardian either party may terminate this agreement by the service of one calendar month’s notice in writing. During that said one month period the nursery undertakes to continue to admit the child and the parent/ guardian undertakes to pay all fees. In the event of the parent/ guardian failing to pay the month’s fee’s the child place shall be immediately withdrawn and the nursery shall be entitled to serve a formal demand for payment of such monies.
  • In the event of the parent/ guardian giving notice of withdrawal of the child and immediately withdrawing the said child there shall be due to the nursery one calendar month’s fees in lieu of notice. Failure by the parent/ guardian to provide one calendar month’s notice or any notice at all shall render the parent/ guardian liable to the nursery for one month’s fees.
  • Notice must be in writing and posted/ emailed to the nursery manager.
  • If in the reasonable opinion of the nursery manager or person of similar standing or authority it is considered that the continued presence of the child referred to herein is detrimental to the health, safety or well being of the child or other children of the said nursery or the teachers, staff so employed, then the nursery may serve notice to the parent/ guardians or a request for the child to be immediately removed from the nursery and the provision of one month’s notice as referred to in-clause (ii) hereinbefore stated shall not apply.
  • In the event that the nursery decides to advertise offers or promotions additional terms and conditions may be applicable.

(6). Variation

There shall be no variation of this agreement unless it is in writing and made between a duly authorised representative of the nursery and the parent/ guardian, any such agreement being in writing from a Director of the Company or the Nursery Management Team.  It is hereby recognised that the nursery is owned by Early Learners Nursery Limited and the members of staff at the nursery are employees of the company.  The employees of the Company at the said nursery are not authorised to bind the Company in respect of the following matter:

  1. The variation of any terms of this agreement except attendance schedule.
  2. The entering into of agreements be they oral or written with the parent/ guardian as to payment schedules of current fees or arrears of fees.
  3. The acceptance of any offer as to the payment of fees or arrears of fees other than in accordance with clause 3.
  4. Any representation as to the rights of the Company to take legal or other proceedings.

(7). Acceptance

The above terms and conditions are considered to be fair and reasonable. In the event of any terms found by a Court of Law to be unreasonable then the clause shall be removed but the agreement shall remain in full force and effect. The parent/ guardian has read and understands the Terms and Conditions contained and undertakes to be bound by the same.

To Take Note:  All children must be accompanied both to and from nursery by a parent or responsible adult, relative or duly authorised adult person (must be at least 16 years of age). As part of the terms and conditions and to complete your application you must sign the Payment Acceptance section.  Nursery must receive payment prior to child starting.

(8). Your Child Assessment

In order for us to maintain a good standard of education and to comply with current legislation, it is necessary for us to observe and assess your child’s development stages. The observations will assist us with our planning for the EYFS curriculum and the future needs of your child. Your child’s key person will be responsible for any observations and recording procedures on your child. Should you have any worries or concerns regarding your child, you should ask to speak to your child’s key person. With your permission we assess and record any details regarding your child we need. Please note any observations or records regarding your child belong to the Parent / Carer.  By initialling below you agree that we can access support from outside agencies to support with your child’s welfare and education.  You also agree that we can share your details with the local authority.  Other than the details raised in section 8 confidentiality shall be maintained at all times and results fed back to the parent/ guardian.
